Terms of service

Company: Tamarack Enterprises LLC dba Tamarack Development Co., a Nevada corporation (“Company,” “we,” “our,” or “us”)

These Terms of Service (“Terms”) govern your use of our applications, websites, and related services (collectively, the “Services”). By downloading or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

1. Eligibility

You must be at least 18 years old and capable of entering into a binding contract to use the Services.

2. Accounts

Certain features may require an account. You agree to maintain the confidentiality of your account credentials and accept responsibility for all activity under your account.

3. Subscriptions and Payment (Apple App Store Purchases)

  • Auto-Renewable Subscriptions: Some features of the Services are available via subscription purchased through the Apple App Store. Subscriptions automatically renew unless canceled at least 24 hours before the renewal date.
  • Payment Processing: Payment, billing, cancellations, and refunds are handled exclusively by Apple via your Apple ID account. We do not have access to or control over Apple’s payment system.
  • Managing Subscriptions: To manage or cancel your subscription, go to your Apple ID Account Settings on your device.
  • Refunds: Refunds are subject to Apple’s refund policies, not ours.

4. License and Restrictions

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your internal business purposes. You may not:

  • Copy, decompile, reverse engineer, or distribute the Services;
  • Use the Services for unlawful purposes;
  • Remove or alter any copyright, trademark, or proprietary notices.

5. Apple Device Terms

When you download our applications from the App Store:

  • These Terms are between you and the Company, not Apple.
  • Apple is not responsible for the Services or their content.
  • Apple has no obligation to provide maintenance or support.
  • In the event of any failure of the Services to conform to any warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation.
  • Apple is not responsible for addressing any claims relating to the Services or your use of them, including product liability, legal compliance, or intellectual property claims.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

6. User Content

You grant us a worldwide, non-exclusive, royalty-free license to use, host, and display User Content solely to operate and improve the Services.

7. Intellectual Property

All intellectual property rights in the Services remain with the Company or its licensors.

8. Termination

We may suspend or terminate your use of the Services if you violate these Terms.

9. Disclaimers

The Services are provided on an “AS IS” and “AS AVAILABLE” basis. We disclaim all warranties, express or implied.

10. Limitation of Liability

To the extent permitted by law, the Company is not liable for indirect or consequential damages. Our maximum liability will not exceed the amount paid by you for the Services in the prior six (6) months.

11. Indemnification

You agree to indemnify and hold harmless the Company and its affiliates against claims arising out of your use of the Services.

12. Arbitration and Governing Law

  • Mandatory Arbitration: Any dispute shall be resolved through binding arbitration administered by the American Arbitration Association (AAA).
  • Class Action Waiver: You may only bring claims on an individual basis.
  • Governing Law: These Terms are governed by the laws of the State of Nevada, except where preempted by federal law.

13. Changes to Terms

We may update these Terms. Continued use of the Services after updates means acceptance of the new Terms.

14. Miscellaneous

  • Entire Agreement: These Terms are the full agreement between you and us.
  • Severability: If a provision is invalid, the rest remain enforceable.
  • Waiver: Failure to enforce a provision is not a waiver.
